This Refund Policy outlines the terms under which refunds, credits, or adjustments may be issued for our various service categories. Please read this policy carefully before engaging our Services.
1. Our Satisfaction Commitment
Our Promise:
We stand behind the quality of our work. If you are not satisfied with the Services delivered, we will work with you in good faith to address your concerns, re-perform unsatisfactory work, or, where applicable, issue a partial or full refund as described below.
2. Refund Eligibility by Service Type
2.1 AI Readiness Assessments
- Cancellation before assessment work begins (before Phase 2 kickoff)
Full refund minus a $500 administrative fee
- Cancellation after assessment work has begun but before final report delivery
Partial refund based on work completed. Client pays for hours worked at agreed rates.
- Dissatisfaction with the quality of the final assessment report
We will re-perform the unsatisfactory portions at no additional charge. If re-performance does not resolve the issue, a partial refund of up to 50% may be issued at our discretion.
- Assessment completed and delivered as scoped
No refund. The assessment deliverable has been provided as agreed.
2.2 AI Implementation Projects
- Cancellation before project work begins (before Phase 1 kickoff)
Full refund of any prepayment, minus a $1,000 administrative fee
- Cancellation during the project (after Phase 1 kickoff)
No refund for work already completed. Client pays for all Services rendered through the cancellation date per the Service Agreement. Any prepaid amounts for unperformed work will be refunded.
- Project deliverables do not meet the specifications in the signed Statement of Work
We will re-perform the non-conforming work at no additional cost, provided written notice of non-conformance is given within thirty (30) days of delivery. If re-performance fails, a partial refund proportional to the non-conforming deliverable may be issued.
- Client terminates due to Scenic Markets LLC's material breach
Full refund of any prepaid amounts for unperformed Services. Client retains ownership of all work completed to date.
2.3 Managed AI Services (Ongoing Support)
- Cancellation with proper notice (30 days written notice as per the Managed Services Agreement)
No refund for the current billing period. Service continues through the end of the paid period. No further charges after the notice period.
- Cancellation without proper notice
No refund. Client is responsible for payment through the end of the current billing period.
- Service Level Agreement (SLA) breach by Scenic Markets LLC
Service credit applied to the next billing period as specified in the Managed Services Agreement. For repeated SLA breaches (3+ in a single quarter), Client may terminate without penalty and receive a prorated refund for the remainder of the billing period.
- Dissatisfaction with service quality (no SLA breach)
We will work with you to address concerns. If concerns cannot be resolved, Client may terminate with 30 days' notice. No refund for services already rendered.
3. Free AI Readiness Assessments and Promotional Offers
Promotional or complimentary AI Readiness Assessments are provided at no charge and are not eligible for refunds or credits of any kind. These assessments are offered as-is with no warranty of completeness or suitability for any particular purpose.
4. How to Request a Refund
To request a refund, please follow these steps:
- Contact us in writing via email at [email protected] with the subject line "Refund Request — [Your Company Name]"
- Include the following information: your company name, the engagement or invoice number, the service(s) for which you are requesting a refund, the reason for your request, and any supporting documentation
- Allow 5 business days for our team to review your request and respond with a determination
- If approved, refunds will be processed within fifteen (15) business days via the original payment method, or by check if the original method is unavailable
5. Non-Refundable Items
The following are not eligible for refunds under any circumstances:
- Third-party hardware, software licenses, or subscriptions purchased on behalf of the Client
- Travel expenses, shipping costs, or other reimbursable out-of-pocket costs already incurred
- Administrative fees or deposits as specified in the applicable Service Agreement
- Services fully performed and accepted by the Client (including signed milestone approvals)
- Custom work already delivered and deployed to the Client's infrastructure
6. Cancellation by Scenic Markets LLC
Scenic Markets LLC reserves the right to cancel or suspend Services if:
- Payment is more than thirty (30) days past due after written notice
- The Client breaches a material term of the Service Agreement or these Terms
- The Client fails to provide required access, data, or cooperation necessary for Scenic Markets LLC to perform the Services
- Circumstances arise that make it impractical or impossible to perform the Services (force majeure events)
In the event of cancellation by Scenic Markets LLC due to Client breach, no refund will be issued for Services already rendered. If cancellation is due to force majeure, any prepaid amounts for unperformed Services will be refunded.
7. Dispute Resolution
If you are not satisfied with the outcome of a refund request, you may escalate the matter by contacting our management team in writing at [email protected]. We are committed to resolving disputes fairly and promptly. All disputes are subject to the dispute resolution provisions in our Terms and Conditions.
8. Changes to This Refund Policy
Scenic Markets LLC reserves the right to update this Refund Policy at any time. Changes will be posted on this page with an updated "Last Updated" date. The Refund Policy in effect at the time of your engagement governs any refund claims for that engagement.
